Section 33.
The mayor is ex officio a member of the council, and shall preside over its deliberations when in
session. He is entitled to vote in case of a tie vote of the council, except in the final
passage of an ordinance. He has authority to preserve order, enforce the rules of the council,
and determine the order of business, subject to such rules, and to appeal to the council. The
mayor is the executive of the municipal corporation, and must exercise a careful supervision over
its general affairs and its subordinate officers. It is his duty to annually, at the regular
meeting of the council appointed by this act, communicate by message to the council a general
statement of the condition of the affairs of this municipal corporation, and to recommend the
adoption of such measures as he may deem expedient and proper, and to make such special communications
to the council from time to time as he may think useful and proper. The mayor shall countersign
all warrants drawn by the recorder upon the treasurer for the payment of money out of the city
treasury. He shall take and approve all official undertakings which the ordinances of this city
may require any officer to give, or any undertakings which may be required of any contractor for
the faithful performance of his contract, and any and all bonds running to the city; and when he
approves such undertakings he shall file the same with the recorder immediately. In case of the
absence of the recorder or of the municipal judge from the city, or inability of either to perform
the duties of the office, or in case of a vacancy in the office of recorder or of municipal judge,
the mayor shall perform such duties, and shall have full power and authority to try and
determine all offenses for violation of the city ordinances, the same as might be done by the
municipal judge, in case he were present and acting, during such vacancy in office or inability
of the recorder or municipal judge to act. The mayor shall perform such other duties and exercise
such other authority as shall be provided by this act, any city ordinance, or any law of this
state, or of the United States.
