Elective Offices

Section 12.

At each biennial general election a mayor shall be elected for a term of two years or until his successor is elected and qualified.

Section 13.

Additional officers of the city shall be recorder, municipal judge, marshal, treasurer, surveyor, engineer, city attorney and such other officers as the council deem necessary. Each of these officers shall be appointed and may be removed by the mayor with the approval by a majority vote of the council.

Section 14.

No person shall be eligible to an elective office in the city who at the time of his election is not a qualified elector or the state or has not resided within the city for three months immediately proceeding his election.

Section 15.

The term of office of every person elected to office under this act shall commence the first of the year immediately following his election and terminate when his successor is elected and qualified.

Section 16.

All officers elected under this act, before entering upon the duties of their office, must take, and file with the recorder, an oath of office to the following effect:

"I, ________________(naming him), do solemnly swear (or affirm) that I will support the Constitution of the United States, and of the State of Oregon, and that I will to the best of my ability faithfully perform the duties of the office of ________________ (naming it) of Falls City during my continuance therein; so help me God." If the person affirn, instead of the last clause, there must be added, "And this I promise under the pains and penalties of perjury."

Section 17.

The council shall provide by ordinance the mode for nominating elective officers.

Section 18.

An elective office shall be deemed vacant upon the incumbent's death, incompetence, conviction of a felony, resignation, or removal from the city; or upon the incumbent's ceasing to possess the qualifications necesary for his office; or upon the failure of the person elected or appointed to an office to qualify therefor within five days after the time for his term of office to commence; and in the case of mayor or councilman, upon his absence from meetings of the council for three consecutive regular meetings of the council without the consent of the council. Vacancies in elective offices of the city shall be filled by appointment by a majority of the members of the council then remaining in office. The appointee's term of office shall begin immediately upon his appointment and qualification therefor and shall continue throughout the unexpired term of his predecessor. During the temporary disability of any officer or during his absence temporarily for any cause, his office may be filled pro tem in the manner provided for filling vacancies in office permanently.
