        Eligibility Requirements:

        If you are operating a business within the city limits, it is necessary to comply with the current city ordinances, specifically Ordinance No. 347 regulating businesses operating within the city limits.

        To operate a business in the City of Falls City, and be listed on the "Businesses" section of the Falls City Website, you must meet the following requirements:

        2. Your business must be within the city limits of Falls City

        Ordinance No. 347

        An Ordinance Licensing and regulating certain businesses, trade and occupations; providing for the manner of issuing licenses; providing penalties for violations, and declaring an emergency.

        The City of Falls City does ordain as follows:

        Section 1. Definitions.

        • (a) The term "person" shall mean and include any natural person, partnership, association or corporation.
        • (b) The term "business" shall mean and include any trade, occupation, profession or business as hereinafter mentioned.

        Section 2. No person shall engage in or carry on any business as hereinafter set forth unless he shall have applied for and been issued a license and paid the fee as herein prescribed.

        Section 3. All applications for licenses shall be made with the City Recorder of Falls City on forms prescribed for such purpose by the City Recorder, and shall be accompanied by a fee as follows:

        • (a) For any business activity conducted in a residental "R" zone as classified by Ordinance No. 346 of the City of Falls City, and which in the year preceding the application realized as gross income of more than $600.00 but less than $1,200.00, the fee shall be $5.00 per annum.
        • (b) For any business activity conducted in a residental "R" zone, which during the year preceding the application realized a gross income in excess of $1,200.00, the fee shall be $10.00.
        • (c) Any person ingaged in the rental of two or more dwelling units shall pay a license fee of $10.00. No license shall be required of any person renting a single family unit, irrespective of the amount of income realized therefrom, or from any person conducting a business, the gross income of which was less than $600.00 in the immediate preceding calendar year.
        • (d) For any business activity conducted in other than a residental "R" zone, the annual licensing fee shall be as follows:
        • (1) Any tavern or other place which sells alcoholic beverages for consumption upon the premises, any service station, garage, restaurant, grocery store, and any other business which hires two or more employees, or which engages in the manufacture of a product, the fee shall be $20.00.
        • (2) For all other businesses, not described in section 3, (d) (1) hereof, the licensing fee shall be $10.00.

        Section 4. The initial period of licensing shall be for the first one-half of the calendar year 1972, and an amount equal to one-half of the annual license fee as prescribed shall be collected by the City Recorder. Thereafter, all licenses shall be issued on an annual basis and shall be due July 1 of each year.

        Section 5. No business license shall be assignable by the licensee. No licenses shall, except with the permission of the City Coucil, conduct any business at any place other than as designated in the license. All licenses shall be prominently displayed upon the licensed premises.

        Section 6. No license shall be issued to any business, the continuance or conduct of which would be in violation of any provision of any other ordinance of the City of Falls City.

        Section 7. Licenses may be revoked by the City Council upon failure of the licensee to comply with any of the provisions of this ordinance or any other ordinance providing for the regulation of businesses herein required to be licensed, or for fraud or misrepresentations made in obtaining a license. Upon any such revocation any pre-paid license fee shall be forfeited.

        Section 8. If the City Recorder shall refuse to issue any license upon application, the applicant shall have a right of appeal to the City Council, and the Council shall determine such matter within sixty (60) days of the notice of such appeal.

        Section 9. Any person who shall not make prompt application for a license required by this ordinance shall pay a penalty as follows:

        • (a) If such application shall be more than 10 days but less than 30 days delinquent, the penalty shall be 25% of the license fee.
        • (b) If such application shall be more than 30 days but less than 60 days delinquent, the penalty shall be 50% of the license fee.
        • (c) If such application shall be more than 60 days but less than 90 days delinquent, the penalty shall be 100% of the license fee.
        • (d) If the applicant shall be more than 90 days delinquent, the City Recorder shall refer such application to the City Council for final decision.

        Section 10. Any person violating the provisions of Sections 2, 3, or 5 of this ordinance, shall upon conviction, be subject to a fine of not to exceed $500.00. After the 90th day of delinquency as set forth in Section 9, each separate day shall constitute an offense under Section 2.

        Section 11. No business conducted within the City of Falls City, subject to the terms of a franchise ordinance and agreement, shall be subject to the provisions of this ordinance.

        Section 12. Inasmuch as the provisions of this ordinance are necessary for the preservation of the immediate health and safety of the Citizens of Falls City, an emergency is declared to exist and this ordinance shall be effective from the date of its passage by the City Council.
