Section 41

The city marshal is a peace officer within the limits of Falls City, and must execute all processes issued by the municipal judge or directed to him by any magistrate of the state. He may make arrests for breach of the peace or commission of a crime within the limits of the city, with or without a warrant, as a peace officer may do under the laws of the state. He must exercise a vigilant control over the peace and quiet of the city. He is a keeper of the city prison or house of correction, unless otherwise prescribed by the council. He must collect all assessments when required by warrant or otherwise, and pay the same to the city treasurer, together with the costs of making the same, monthly. He must attend regularly upon the sittings of the municipal court, and upon the meetings of the city council. He is the chief of police, has control of all policemen, appointed by the council when they are upon duty, and may suspend any policeman for negligence or violation of duty until the case can be examined into and determined by the council. All fees earned and collected by the marshal, or any member of the police force, in the municipal court, for a violation of any city ordinance or crime against a state law, shall be turned over to the city treasurer immediately. He shall take duplicate receipts for all moneys turned over to the city treasurer, one of which he shall file with the recorder. He shall do and perform all other duties prescribed in this act or by the ordinances of the city, or by the council, not inconsistent with the duties in this act prescribed.
